HUD Charges Kansas Property Owners With Fair Housing Violations

The Department of Housing and Urban Development (HUD) is charging a Kansas landlord with Fair Housing Act violations after allegations of sexual harassment. According to a press release on the HUD official site, the agency “announced today it is charging the owner and landlord of several rental properties in Wichita, Kansas, and his wife, who co-owned one of the properties, with housing discrimination after the landlord allegedly sexually harassed two female tenants at his properties. HUD’s charge further alleges that he also made discriminatory statements based on one of the women’s race”. The Fair Housing Act prohibits a wide range of discriminatory practices in housing including sexual harassment. HUD Secretary Ben Carson On Hurricane Harvey Disaster Relief

The head of the Department of Housing and Urban Development has written an open letter to the victims of Hurricane Harvey discussing the FHA/HUD outreach to affected areas and options for disaster relief. According to the FHA/HUD official site, HUD Secretary Ben Carson addressed those in the federal disaster areas in Texas stating, “HUD is tasked with comprehensive, long-term disaster relief and has been working on the front lines in Texas. HUD Announces Settlement In Fair Housing Complaints Against The State Of Maryland

The Department of Housing and Urban Development has announced a settlement in a Fair Housing case involving complaints against the State of Maryland. According to HUDNo.17-088, the agency has “…announced an agreement to resolve a discrimination complaint brought by fair housing advocates against Maryland’s Department of Housing and Community Development (DHCD) challenging the fairness of the State’s Low-Income Housing Tax Credit Program.” Under the terms of the agreement, new or modified policies, incentives, and “more flexible program rules” will be enacted to “streamline the creation of affordable housing in higher opportunity neighborhoods in the Baltimore region”. The origin of the case involved a complaint filed with HUD in 2011. HUD Announces Further Disaster Relief For U.S. Virgin Islands

The Department of Housing and Urban Development has announced disaster relief for St. Croix Island, the latest of the U.S. Virgin Islands to be declared a major federal disaster area. There have been a string of announcements for areas in Puerto Rico and elsewhere as the damage has been surveyed and, in some cases, when additional concerns are raised by new tropical storms and hurricanes. St. Croix is now able to receive federal disaster assistance from FEMA, HUD, and the FHA among other agencies. Home owners in presidentially-declared major disaster areas should contact FEMA as soon as possible to determine what benefits and relief are available to them. After Hurricane Irma and Hurricane Harvey, the Department of Housing and Urban Development has been issuing press releases as more federal disaster areas are declared in affected counties. When the government names such disaster areas, they become eligible for a variety of relief measures including FHA 203(h) loans for disaster victims. During this particular set of disasters, there’s been a trend( in news media and among those affected by the hurricanes) to refer to those who have experienced them as “survivors” rather than “victims”. It’s a question some borrowers won’t need to ask, but it is one that can and often does affect some transactions-especially where condo loans are concerned. The Department of Housing and Urban Development has announced an extension of FHA 203(h) loans for qualifying residents of federally declared disaster areas in Louisiana. The FHA 203(h) program is described in the FHA Single Family Handbook HUD 4000.1. “Section 203(h) of the National Housing Act authorizes FHA to insure Mortgages to victims of a Presidentially-Declared Major Disaster Area (PDMDA) for the purchase or reconstruction of a Single Family Property.” According to the HUD official site, there is now an “additional period of eligibility for section 203(h) mortgage, as a result of the extension of Federal Assistance for victims of the March 13, 2016 and August 14, 2016 Presidentially-Declared Major Disaster Areas of Louisiana…”. HUD Kicks Off National Homeownership Month

The HUD official site (www.HUD.gov) has announced that June is National Home Ownership Month. According to a HUD press release, June has been declared a time, “to reflect upon the impact owning a home has on household wealth, neighborhood stability and the nation’s broader economic health. How do actions like deed-in-lieu of foreclosure or actual foreclosure affect borrowers and their chances at getting new FHA home loans? A reader asks: “I have a bankruptcy filed and discharged in 2012. My 1st and Heloc were not reaffirmed. I will be moving out of California and to Arkansas but want to know how FHA would look at the wait for purchasing if I: Surrender property in deed in lieu, or Allow the home to be foreclosed upon. Cash To Close And Earnest Money: FHA Loan Rules

All home loans have requirements for cash to close the deal, earnest money, and down payments. The FHA loan rules for these are found in HUD 4000.1, which has instructions to the lender on how to verify and process these payments. For example, on page 296 of HUD 4000.1, we learn the following: “The Mortgagee may only consider assets derived from acceptable sources in accordance with the requirements outlined below. Closing costs, prepaid items and other fees may not be applied towards the Borrowers Minimum Required Investment” also known as the down payment.
